Terms of use

Last updated October 15, 2026. These terms are an agreement between you and Von Fortmeyer, LLC ("we") about the Buddy Towers iOS app, its iMessage extension and the website buddytowers.com (together, "Buddy Towers").

1. Agreement

By using Buddy Towers you agree to these terms and to the privacy policy. If you do not agree, do not use Buddy Towers. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.

2. The app and Apple

The iOS app is licensed to you under Apple's Licensed Application End User License Agreement. These terms add to that agreement. If they conflict about the license to the app, Apple's agreement controls. Apple is not responsible for Buddy Towers or for support of it.

3. Using Buddy Towers

• Choose a player name that is not offensive, hateful, sexual, threatening, or someone else's identity. We may refuse or remove names, end rooms, or limit access for names or behavior that break these terms.
• Do not cheat, use bots in live races, interfere with or overload the servers, probe them for vulnerabilities outside the process in our security policy, or reverse engineer Buddy Towers except where the law allows it.
• Live rooms are joined with a room code. Anyone with the code can join and see the names, crews and moves of the players in that room.

4. Purchases

• Crew packs are optional, one-time purchases made through the App Store. They change how the game looks, not how it plays. Apple processes payment and its terms apply.
• A purchased pack is a license to use that content in Buddy Towers. It has no cash value and cannot be transferred or exchanged.
• Refunds are handled by Apple at reportaproblem.apple.com. Nothing in these terms limits refund or cancellation rights you have under the law where you live.
• Use Restore Purchases in the Crew store to unlock packs on a new device signed in to the same Apple account.

5. Content and trademarks

Buddy Towers, its characters, artwork, music, code and names are owned by Von Fortmeyer, LLC or its licensors and are protected by law. We grant you a personal, non-commercial right to use Buddy Towers under these terms. Sharing your results, replays and screenshots for personal, non-commercial purposes is welcome. Third-party licenses are listed in Credits.

6. Changes and availability

Buddy Towers is provided as it is, and features may change, be added or be removed. Live races depend on internet servers that may be unavailable at times. We may update these terms. If a change is material, we will update the date above and note it in the app's release notes. Continuing to use Buddy Towers after a change means you accept it.

7. Disclaimers

To the extent the law allows, Buddy Towers is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Some places do not allow these exclusions, so they may not apply to you.

8. Limitation of liability

To the extent the law allows, Von Fortmeyer, LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of Buddy Towers. Our total liability for any claim is limited to the amount you paid for Buddy Towers in the 12 months before the claim, or US$50 if you paid nothing. Nothing in these terms limits liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence.

9. Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Disputes will be decided by the state or federal courts located in California, and you and we consent to their jurisdiction. If you are a consumer in the European Union, the United Kingdom or another place whose law gives you mandatory protections, you keep those protections and may bring claims in the courts where you live.

10. General

If part of these terms cannot be enforced, the rest stays in effect. Not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor operating Buddy Towers.
